Terms And Conditions

The following Terms and Conditions constitute the business and travel agreements between Sky Extra Tours & Travel and every person whose name is listed on the Customer Booking Form or email communications or both. The Contract is governed by Kenyan law and the parties agree to submit to the jurisdiction of the Kenyan Courts.

GENERAL:
  • These Terms and Conditions contain all the terms and conditions of the agreement between the parties. The parties acknowledge that there are no understandings, representations, or terms between them, save for those as set out herein.
  • If any provision of this Agreement is found by a court of law to be invalid or void, such provision will be severed from the remaining provisions, without affecting the remainder of the agreement hereof. 
  • This Agreement and all matters or disputes arising therefrom or incidental thereto shall be governed and construed in accordance with the laws of the Republic of Kenya.
  • The client consents to the jurisdiction of the Magistrate’s Court, notwithstanding the fact that the amount involved exceeds the jurisdiction of the Magistrate’s Court. The client agrees, however, that the Company in its sole and absolute discretion may institute any such action or proceedings in any division of the High Court that may have jurisdiction and further agrees that each party shall bear their own associated legal cost. The client shall not be entitled to cede any of its rights or assign any of its obligations under this Agreement.
  • If Sky Extra Tours & Travel institutes any legal proceedings against the client to enforce any of its rights under this agreement, it shall be entitled to recover from the Client all legal costs that it incurs to its own attorneys on an attorney/own client basis, including but not limited to collection commission and tracing agent charges.
LAWS:

Clients are advised to follow the laws and rules that govern the host countries including park regulations and not go against those laws. Some laws might be different from the laws of their countries.

RESPONSIBILITY:

All bookings are accepted on the specific condition that Sky Extra Tours and Travel acts only as a booking agent for the tour members in making arrangements for hotels, transportation, sightseeing, restaurants, or any other services in connection with any itinerary.

However, Sky Extra Tour and Travel does not assume any liability whatsoever for any injury, damage, loss, accident, or delay to person(s) or property due to any act or default of any hotel, carrier, restaurant, company or person or any of their servants or agents rendering any of the services included in the tour.

Furthermore, Sky Extra Tours and Travel accepts no responsibility for any damage or delay due to sickness, pilferage, labor disputes, machinery breakdown, quarantine, government restraints, weather, or any cause beyond their personal control. The right is reserved to cancel or change itineraries or substitute services without notice and to decline to accept or retain any tour members at any time. 

Liability:
  • The company liability to passengers carried in vehicles for transfers, excursions, and tours is governed by the law of Kenya and all claims are subject to the courts of Kenya. Whilst every care is taken, the company shall not be held liable for loss or damage to personal property, and clients are advised to arrange relevant travel insurance unless advised as included.
  • Sky Extra Tours & Travel does accept responsibility for acts and or omissions of our employees, agents, or suppliers. In addition, Sky Extra Tours & Travel accepts responsibility should the services we are contractually obliged to provide prove deficient or are not of a reasonable standard. Where the services in question consist of carriage by air or by the sea our liability is limited to the extent of international conventions.
  • We shall not be responsible or accept liability for death, injury or illness or damage to property suffered or caused to any guest while on a holiday booked with us except as a result of the negligence of our employees, agents, suppliers, or sub-contractors acting in the course of or in the scope of their employment (other than air or sea carriers performing any internal, domestic or international carriage of whatsoever kind).
  • Should in the unlikely event there because for complaint clients are requested to raise it with Sky Extra Tours & Travel or the agent, employee or supplier concerned at the time. On completion of your holiday if there are any unresolved issues then you are requested to raise them in writing to us within 28 days of returning from your holiday.
  • If a client is prevented from taking the holiday, the client shall have the right to transfer his or her booking to a suitable person, provided that notice of such transfer is given to Sky Extra Tours & Travel in writing at least 21 days before departure.
  • If the client transfers the holiday pursuant to 14 above the client and the transferee shall be joint and several liable for the holiday price (or the unpaid balance of the holiday price as the case may be) and also for any additional costs incurred by Sky Extra Tours & Travel as a result of the transfer. The additional costs shall include (without limitation) reasonable administrative costs for arranging the transfer and any cancellation charges which may be imposed by the suppliers to Sky Extra Tours & Travel.
HEALTH:

The client should familiarize him/herself with the tour itinerary and confirm that they are medically fit to undertake the tour. Any participant with a known medical illness or condition must reveal this fact at the time of booking, and make the necessary arrangements for the provision of any drugs or treatments that may be needed during the tour. Such clients will be required to provide a medical certificate from his or her doctor to confirm that they are physically fit to travel. Sky Extra Tours & Travel will hold this information in the strictest of confidence. It is necessary to have comprehensive medical insurance for this trip. It is the client’s sole responsibility to ensure that they have had all necessary inoculations, immunizations, and medications required prior to departure. 

PRICES:

This includes all expenses as outlined in the itineraries, brochures, or website.

Change of Rates and Prices:

Hotels, Lodges, Airlines and all other service providers reserve the right to change their rates and tariffs, with or without notice. Sky Extra Tours &Travel therefore cannot guarantee that all the published rates and tariffs will be valid at the time of published.

Prices are valid for the periods shown but are subject to change without notice in the event of not limited to, Government action, increase in hotel tax or VAT, or to increase if prices are significantly affected by other circumstances beyond our control and changes in hotel prices by the hotel.

Prices are based on exchange rates prevailing at the time of publication and may alter should any major variation in exchange rates occur. Prices quoted for holiday packages includes what is mentioned in the itinerary, it excludes activities not mentioned. 

Reservation & Payments:

A non-refundable deposit is required on booking and the balance 4 weeks before the booking date, although in certain circumstances larger deposits are required. If booking within 4 weeks of the booking date, the whole amount is payable at the time of confirmation. Notwithstanding any prior confirmation of arrangements, the right is reserved not to undertake a booking if payment is not made by the foregoing. For international air tickets, full payment will be required at the time of booking. Exact terms and conditions of the airline ticket will also apply. These vary with the airline and with the type and class of the ticket and are available on inquiry or at the time of booking.

Credit Card Payment:

The client must have a valid credit card; the client bears the charges for swiping the card, the cost of booking and confirmation will be valid at the time of paying with the card. Payment by card should be done way in advance as advised by Sky Extra Tours and Travel team.

TRANSPORTATION:

We have a wide selection of vehicles ranging from luxury vans to deluxe minibusses all air-conditioned and refrigeration system,s and 4×4 safari land Cruisers and therefore Airport/city transfers are done based on client requirements and depending on group size.

Passports and Visas:

It is the Client’s sole responsibility to ensure that his/her passport, necessary permits, and travel documents are valid and that they have obtained all the necessary permits and/or visas required by the countries which they intend to enter, prior to their departure.

The Company cannot be held liable for any visa or travel documentation not held by the Client, nor will they be held liable should a passenger be refused entry into any country for any reason.

Travel Insurance:

Sky Extra Tours & Travel will purchase a medical evacuation insurance for clients who request the service.

It is the client’s responsibility to ensure they purchase adequate travel and medical insurance. The client cannot hold Sky Extra Tours & Travel liable for any advice and/or inadequate and/or the non-purchase of travel insurance.

Flights:

Clients are required to cross-check flight timings and names of the flights including their names at the time of booking and rectify before the tickets are issued. Any costs arising for changes after the ticket is issued is borne by the client. Sky Extra Tours and Travel is not liable for errors arising from this and subsequent costs. Cancellation for whatever reason is subject to airline cancellation policies of which the client will take care of the cost.

Domestic Flights:

There is a maximum luggage limitation of 15kgs per person (preferably in soft/duffle bags) on all local charters and scheduled flights between parks and cities. Excess baggage is charged at the prevailing freight rate and is strictly subject to space availability.

Authority and exclusion from tour:

Sky Extra Tours & Travel takes no responsibility for the actions of participants who commit any unlawful acts in Kenya. Sky Extra Tours & Travel reserves the right to exclude any client from the tour if their behavior warrants it.

Passenger luggage and personal effects:

Baggage insurance is recommended as Sky Extra Tours & Travel can assume no responsibility for loss and damage to luggage or personal belongings, under any circumstances. Baggage turned over to Sky Extra Tours & Travel for transport each day is done so at participant’s own risk. Passenger’s baggage needs to be clearly marked with their name and surname.

SAFARI ORIENTATIONS:

Unless the safari is private, clients will share the facilities with others. Clients are therefore advised to be good-natured and enjoy being with others. Be prepared to encounter customs and habits which may be different from your own and form part of the adventure.

Changes of Itinerary:

The sequence of itineraries is normally adhered to but the company reserves the right to make alterations occasioned by weather, road works, high season congestion, or any other unforeseen circumstances without taking any liability.

Cancellation:

Incase booking is canceled the following cancellation fees shall apply:

  • No show          – 100%
  • 1 – 7 Days        – 75%
  • 7 – 14 Days      – 50%
  • Above 14 Days – 25%

Note: That the specific hotel and airline cancellation policies will also apply. The policies are applied only as a means of protection against similar charges levied by the service providers. At all times we shall endeavor to discuss with our suppliers and service providers to waive cancellation charges should they be successful in re-selling all the services canceled at an equivalent rate. This applies especially to cancellations or attritions made between the 59 – 15 days to arrival window period.

Government action such as increases in VAT or any other Government imposed increases, the cost to us of any part of the holiday as a result of currency fluctuation. If this means paying more than 10% on the holiday price, you will be entitled to cancel your holiday with a full refund of all money paid except any amendment charges. Should you decide to cancel because of this, you must exercise your right to do so within 14 days from the issue date printed on the invoice.
